Beijing Issues Notice to Printing, Reproduction and Distribution Enterprises on Stronger Internal Management and Lawful Operation
The Beijing Municipal Bureau of Press, Publication, Radio, Film and Television has issued a notice on further strengthening internal management and raising the level of lawful operation among printing, reproduction and distribution enterprises.
The notice is addressed to all printing, reproduction and distribution enterprises across Beijing.
According to the notice, the 65th anniversary of the founding of the People's Republic of China and the APEC informal leaders' meeting to be held in Beijing in November provide the backdrop for the local printing, reproduction and distribution sector to maintain healthy, orderly and safe production and operations and to help foster a positive cultural environment in the capital. While lawful and standardized operations are generally in good shape, there have been occasional cases in which a small number of enterprises failed to follow industry regulations strictly, operated in violation of rules, or even engaged in illegal business activities and were investigated. Enterprises are therefore urged to build on the work of recent years, further strengthen internal management and improve lawful operation. The notice sets out the following requirements.
- Provide education and training. Enterprises should take account of their operating conditions and workforce quality, regularly arrange for managers and frontline employees to study industry regulations and policies as well as job-related skills. They should prepare and implement employee training plans, and adopt practical measures to support and encourage self-study. Through training and self-study, employees should become familiar with industry rules and policies, clearly understand the bottom line for rejecting illegal printing, reproduction and distribution, clearly understand the bottom line for controlling hidden production accident risks, strengthen their commitment to lawful operation and safe production, and consciously protect cultural security and production safety in their work.
If the legal representative or principal person in charge of operations of a printing enterprise has not obtained a qualification certificate from regulations training, or obtained it more than 5 years ago, the enterprise must promptly register for training organized by the Beijing Municipal Bureau of Press, Publication, Radio, Film and Television.
The Bureau plans to work with district and county cultural committees in October 2014 to organize a Printing Regulations Study Month for printing enterprises citywide. A separate activity plan will be issued. During the Study Month, knowledge competitions will cover printing industry regulations, safe production and green printing. Printing enterprises should actively organize their own competitions, encourage employees to answer questions, and send contestants to competitions organized by their district or county cultural committee and by the Bureau.
- Investigate compliance. Enterprises should, based on their own circumstances, conduct regular and irregular reviews of possible problems in every link of production and operation. For printing enterprises, the main focus is how well the five systems for printing management are implemented, especially the printing entrustment letter system for books and periodicals, verification of printing permits for internal publications, and verification of printing permits for overseas printed materials.
Where problems are found, the enterprises concerned must move quickly to take effective measures, improve relevant systems, correct unlawful conditions, stop illegal operations, remove hidden accident risks, and return to lawful, standardized operation and safe production.
- Improve enterprise systems. Enterprises should frequently review their own rules and regulations in line with industry laws and regulations based on self-inspection. Printing enterprises should follow the Provisions on the Administration of Printing of Printed Materials, focusing on systems for printing verification, printing registration, custody of printed materials, delivery of printed materials, and destruction of defective printed materials from printing activities. Reproduction enterprises should follow the Measures for the Administration of Reproduction, focusing on systems such as verification for accepting reproduction business. Distribution enterprises should follow the Provisions on the Administration of the Publication Market, focusing on systems for purchasing and selling publications and mechanisms for monitoring publication content. In addition, enterprises should improve safe production systems and equipment operating procedures in light of self-assessment of hidden accident risks, strengthen enforcement, and improve results.
- Strengthen accountability. On the basis of comparative checks and improved rules, enterprises should further strengthen the responsibility mechanism for internal management, clarify job duties and accountability rules, and apply a strict responsibility mechanism to key positions in business processes and production safety control. To maintain standardized operations and production safety, dedicated personnel should be assigned to keep internal management information flowing smoothly so that national industry regulatory policies can be implemented in a timely manner. Printing and reproduction enterprises must conscientiously refuse printing and reproduction business that lacks lawful entrustment procedures; and when book or periodical printing entrustment letters or reproduction entrustment letters have not been issued, or have been issued but not yet filed for the record, they must resolutely not start machines for printing or reproduction;
when hidden accident risks emerge in production processes or equipment, they must resolutely stop the machines; and when fire-fighting facilities are ineffective, they must resolutely correct the situation. Distribution enterprises must conscientiously ensure that all publications are purchased and sold through lawful procedures and channels; if there is any doubt about an unclear source of publications, or if publication content is illegal or prohibited, they must immediately stop purchasing and selling. Through responsibility systems with dedicated posts and personnel, these requirements should be met, eliminating the printing, reproduction and distribution of illegal publications and reproductions, eliminating the printing, reproduction and distribution of infringing and pirated publications and reproductions, and eliminating production safety accidents.
- Cooperate with supervision. The Bureau, together with district and county cultural committees, will conduct regular and irregular inspections of printing, reproduction and distribution enterprises. Inspection results will be part of the enterprises' annual verification. Clues of illegal operations found during inspections will be referred to municipal and district cultural law enforcement departments for case filing and investigation. Enterprises should treat cooperation with supervision and inspections by press and publication administration departments and cultural law enforcement departments as an important part of management. If administrative or law enforcement departments identify shortcomings or problems in lawful operation, standardized operation or safe production, enterprises must immediately remedy and resolve them.
