Shanghai Enacts China's First Packaging-Reduction Rules: Key Points of the New Regulation
On November 21 last year, the 37th session of the Standing Committee of the 13th Shanghai Municipal People's Congress voted through the Several Provisions of Shanghai Municipality on Reducing Commodity Packaging Materials (the Provisions), which took effect on February 1 this year. As China's first regulation dedicated to restricting excessive packaging and advancing the reduction of commodity packaging materials, it is regarded as an important institutional move to encourage moderate packaging and to drive energy conservation and emissions reduction. Shanghai has issued a detailed interpretation of the rules.
The consequences of excessive packaging reach well beyond wasted resources and environmental pollution: it also pushes up product prices, leaves consumers bearing artificially high costs, and opens the door to corrupt practices.
The Provisions set out three legislative objectives. First, to restrain and limit excessive packaging of commodities so that the country's mandatory standards are effectively enforced. Second, to reduce packaging waste and household garbage, promote comprehensive utilization of resources, and support Shanghai's economic and social transformation. Third, to encourage reasonable packaging of commodities, guide healthy, thrifty and environmentally sound consumption habits, and foster sound social practices. The Provisions further encourage enterprises to give priority to packaging materials that are recyclable, renewable, recoverable or readily degradable, and advocate that producers and sellers clearly indicate on outer packaging information such as packaging recovery and reuse and packaging costs, and carry out the recovery and reuse of packaging materials.
