Excessive Packaging Banned as New Cleaner Production Promotion Law Takes Effect; Enterprises No Longer Pay for Cleaner Production Audits
The New Cleaner Production Promotion Law came into force yesterday, introducing explicit curbs on excessive packaging and ending the practice of making enterprises foot the bill for cleaner production audits.
In categories such as baijiu, tea and health supplements, three or four layers of inner and outer packaging are commonplace, and retail prices sit far above those of comparable items in ordinary packaging. Now that the law is in force, this “over-dressed” packaging is expected to be reined in, cutting waste and helping push prices lower.
Wang Guangtao, chairman of the Environment and Resources Protection Committee of the National People's Congress, said in his reading of the new law that the key to solving the excessive packaging problem lies in regulating and guiding enterprises — food and health supplement manufacturers in particular — to reduce packaging resource consumption and waste generation at the design and production stages.
The law states that enterprises must package products reasonably, with packaging material, structure and cost commensurate with the quality, specifications and cost of the product inside; packaging waste must be reduced; and excessive packaging is prohibited outright.
Wang also told media that enterprises will no longer fund cleaner production audits. Under the earlier implementation of the Cleaner Production Law, companies had to pay for any cleaner production audit; the new rules explicitly bar government authorities from charging enterprises when they review, approve or verify the results of mandatory cleaner production audits. A dedicated clause has been added: the central government is to strengthen fiscal guidance for promoting cleaner production, while local authorities are also required to allocate a certain amount of fiscal funds to guide the development of enterprises that actively pursue cleaner production.
