China Releases Nationwide Management Measures for Packaging Machinery Repair Outlets

Industry update:

As agriculture, animal husbandry, sidelines and fishery continue to develop, packaging machinery repair demand covers a wide area and carries a heavy workload. These Measures are formulated to establish a packaging machinery repair system and strengthen management of repair services.

Article 1 A packaging machinery repair outlet means a packaging machinery repair business that treats repair of agricultural, animal husbandry and fishery machinery as its main activity and may be state-owned, collective (cooperative) or individually operated.

Article 2 A service outlet applying to provide packaging machinery repair may begin operations only after the local agricultural machinery administration has signed its opinion, the county-level agricultural machinery administration has assessed it and issued a technical qualification certificate, and the industry and commerce administration has granted a business license.

Article 3 Packaging machinery repair outlets may coexist in state-owned, collective (cooperative) and individual forms, each leveraging its strengths. They must follow state policies, laws and repair-related rules, and accept technical guidance and management from agricultural machinery and industry and commerce authorities.

Article 4 Repair outlets should focus on economic results, prioritize energy conservation and aim to improve the technical condition of agricultural machinery and implements. Services should be convenient, prompt and economical.

Article 5 The county agricultural machinery authority shall determine a repair outlet's packaging machinery repair grade based on its technical level and its tools, instruments and equipment. The industry and commerce authority shall set its service items under relevant rules. Repair services must stay within the business scope stated in the license, and no entity or individual may interfere without justification.

Article 6 Hiring helpers and taking on apprentices shall follow relevant State Council provisions. Contracts must be signed to define each party's rights, obligations, term and remuneration.

Article 7 Repairs must meet technical standards and process specifications to ensure quality. If a machine part is damaged because of repair technique, the outlet is responsible for compensation. Disputes between users and outlets over repair quality shall be mediated by the agricultural machinery authority.

Article 8 Measuring tools, instruments and repair equipment at packaging machinery repair outlets must undergo frequent self-inspection and be sent to the metrology department for periodic testing as locally required. They may be used only after passing inspection.

Article 9 Packaging machinery repair outlets shall keep repair technical files (or cards), record the machinery and implements they service, and report their work regularly to the agricultural machinery authority.

Article 10 County agricultural machinery authorities shall organize training for repair workers at outlets at all levels and assess them against national technical grade standards. Those who pass receive certificates.

Article 11 Charges for labor time, parts and materials shall follow the unified fee standards set by the province, autonomous region or municipality directly under the Central Government. Agricultural machinery and industry and commerce authorities have the right to supervise and inspect.

Article 12 Packaging machinery repair outlets shall pay taxes and management fees under national and provincial government rules. Agricultural machinery departments may charge a reasonable technical service fee for paid technical services provided to these outlets. No unit may collect or apportion other fees, or transfer their repair tools, instruments, equipment, premises or funds without compensation.

Article 13 New materials, technologies, processes and equipment suited to local packaging machinery repair should be promoted. Where conditions allow, old parts should be repaired to lower maintenance costs. Required repair materials and supplies should be included in planning.

Article 14 Packaging machinery repair outlets may use multiple service methods to actively serve users.

Article 15 Technical job titles for technical personnel at agricultural machinery repair outlets shall be handled under relevant national rules.

Article 16 If a packaging machinery repair outlet provides poor quality, charges high fees or violates rules, agricultural machinery and industry and commerce authorities may issue a warning or impose a fine of up to 1,000 yuan, depending on the circumstances.

Article 17 Packaging machinery repair outlets shall formulate specific service pledges under these Measures, publicize them and implement them earnestly.

Article 18 Provinces, autonomous regions and municipalities directly under the Central Government shall formulate implementation rules based on these Measures.

Article 19 These Measures take effect on the date of issuance.
