Canada’s Single-Use Plastics Ban Faces Second Lawsuit as RPUC Manufacturers Seek Federal Court Halt

A new legal push against Canada’s single-use plastics ban has reached the Federal Court of Canada, where more than 20 plastic products manufacturers have jointly asked the court to halt the measure. Operating as the Responsible Plastic Use Coalition (RPUC), the companies are making their second legal challenge to the government’s plan to ban single-use plastic items.

In 2021, these manufacturers filed a lawsuit centered on whether plastic products should be classified as toxic. The Canadian government had added certain plastic products to the list of toxic substances under the Environmental Protection Act, and the plaintiffs asked the court to strike down that law.

Canada’s Liberal federal government intends to prohibit the import and production of plastic bags, foam takeout containers, single-use plastic tableware, straws, stir sticks and six-pack rings by the end of this year, followed by a sales ban by the end of next year and an export ban by the end of 2025. In its lawsuit, RPUC seeks to cancel this plan, bar the government from using Environmental Protection Act provisions to regulate the production and use of single-use plastic items, and temporarily freeze the ban until a final ruling is issued.

Canada’s Environment Minister Steven Guilbeault said he is optimistic that the court will uphold the single-use plastics ban. He also noted that, instead of meeting manufacturers in court, he would prefer to work with them to improve plastic recycling.
